This tier covers more serious felonies that did not result in serious bodily injury and are not excluded by law (see below).
- Eligibility:
- No pending charges.
- No new convictions for at least 8 years since the date of conviction or 3 years since completing your sentence, whichever is later.
- All fines, fees, and restitution have been paid in full.
- You are not a sex offender or a violent offender.
- The Outcome: The court has the discretion to grant your petition, but it is not mandatory. Having an experienced attorney to present a compelling case is essential here.
Tier 3: Serious Felonies & Excluded Offenses
Some felonies, due to their nature, have much stricter requirements or are entirely ineligible for expungement.
- Eligibility (for certain offenses):
- No pending charges.
- All fines, fees, and restitution have been paid in full.
- No new convictions for at least 10 years since the date of conviction or 5 years from the completion of your sentence, whichever is later.
- The prosecuting attorney must consent in writing to the expungement.
- Excluded Offenses: Indiana law explicitly prohibits expungement for certain serious crimes, including murder, voluntary manslaughter, sex or violent offender crimes, felonies that resulted in serious bodily injury, and certain crimes committed by elected officials.
